IRS suspends requirement to repay excess advance payments of the 2020 Premium Tax Credit


Taxpayers with excess advance payments of the Premium Tax Credit (excess APTC) for 2020 are not required to file Form 8962, Premium Tax

Credit, or report an excess APTC repayment on their 2020 Form 1040 or Form 1040-SR, Schedule 2, Line 2, when they file. The American

Rescue Plan Act of 2021 suspends the requirement that taxpayers increase their tax liability by all or a portion of their excess advance payments

of the Premium Tax Credit (PTC) for tax year 2020. The process remains unchanged for taxpayers claiming a net PTC for 2020. They must file

Form 8962 when they file their 2020 tax return. Taxpayers who have already filed their 2020 tax return and who have excess APTC for 2020 don’t

need to file an amended tax return or contact the IRS. The IRS will reduce the excess APTC repayment amount to zero with no further action

How to pay estimated taxes_______________________________

C-Corporations and self-employed (proprietors, partners, LLC members) should remember to pay their quarterly estimated income tax payments based on their net income each quarter.  Employers are liable for payroll tax deposits (and employer tax returns) including the trust fund taxes (employee withholdings) and their own employer liabilities.  Many businesses owe sales & use taxes, tariffs, personal property taxes, and other taxes.  Consult with your accountant if you do not know what taxes you owe or if you are confused as to what taxes you owe for any tax year.  Do NOT wait to see what happens as that could result in expensive penalties and interest assessed for you or your business.  Understanding the tax responsibilities when starting a new business can save taxpayers money and help set them up for success. IRS.gov has the resources and answers to help people through the process of starting a new business.   

Form 1040-ES, Estimated Tax for Individuals, includes instructions to help taxpayers figure their estimated taxes. They can also visit 

IRS.gov/payments to pay electronically. The fastest and easiest ways to make an estimated tax payment is by using IRS Direct Pay, the IRS2Go app or

the Treasury Department’s Electronic Federal Tax Payment System (EFTPS). For information on other payment options, visit IRS.gov/payments. If paying

by check, taxpayers should be sure to make the check payable to the “United States Treasury.”
 
Publication 505, Tax Withholding and Estimated Tax, has additional details, including worksheets and examples, that can be especially helpful to those who

have dividend or capital gain income, owe alternative minimum tax or self-employment tax, or have other special situations.

Tax help is available 24/7 on IRS.gov. The IRS website offers a variety of online tools to help taxpayers answer common tax questions. For example,

taxpayers can search the Interactive Tax AssistantTax TopicsFrequently Asked Questions, and Tax Trails to get answers to common questions.

The IRS is continuing to expand ways to communicate to taxpayers who prefer to get information in other languages. The IRS has posted translated tax

resources in 20 other languages on IRS.gov. For more information, see “We Speak Your Language.”

The following tax return for the city of Westminster, Colorado will soon be due:
Reporting Period: January - March 2021

Due Date: April 20, 2021

Returns (and payments, if any) must be postmarked on or before the due

Sales and use tax returns can be filed online using the city’s F.A.S.T. Filing system. If taxes are due, the system will require your bank routing

Final 2019 and 2020 Income Tax Returns Processing at RBSI Virtual Tax Office

There are about 16 income tax returns yet due from the RBSI Virtual Tax Office includin May 17, September 15, October 15, and

November 15

filing dates.  The corporate returns are taking the longest to date.  (The other affiliated tax offices, and many unaffiliated offices, are still

backed up by at least a month.)  The remaining income tax returns will resume checking, processing, and uploading for review and signatures on

Tuesday, April 20, 2021.  They will

be done in the order ready in the system and Jeanine will personally e-mail you as soon as your review and signing documents are

uploaded to your encrypted cloud folder.  The IRS changed the Form 1040 instructions for the 2020 returns YESTERDAY so the individual returns

will need to be checked twice to confirm readiness for your review.  Please be patient if you have not received your review.

Current RBSI clients had income tax season 2021 priority through February 28, 2021 for this income tax filing season.  Tax returns

scheduled after this date get put into the processor in order received and ready.  Those who made the February 28 priority date of

all tax preparation requirements are guaranteed their review and signature documents by on or before your filing date or as of May 7,

2021, whichever comes first, as revised by the change of initial filing date.  Those who sent us everything (signed/dated engagement

letter, retainer and final 2020 payments, completed tax organizer, and tax documents) by ten business days prior to their filing date

are guaranteed their review and signature documents by three days prior to the filing due date.  Others are added to the processor in

the order received and ready.   This priority system for the virtual processor is the fairest way to get all income tax returns processed while we 

continue to handle the payroll tax returns, sales/use tax returns, property tax returns, payrolls, and accounting done on other systems.  

Are ALL of your income tax filing requirements received:  (if not, your priority status can be holding you up)

--Signed-dated engagement agreement,

--final 2020 fees,

--completed tax organizer, and

--tax documents.

We are moving as quickly as possible.  Our apologies for any delays as there have been extra complications with technologies, the Covid-19 legislation, and many interviews during the 2021 income tax season.  All of our offices (RBSI Virtual, Finer Points, Palisades Hudson) thank you for your patience.

Extensions with RBSI Virtual Office must generally be requested by or before the original filing due dates.  They require a $150 retainer for you to stay in our scheduler in a priority status for processing unless you are a new client just joining our service.  If you are in a hurry and missed the priority deadline, then Jeanine will be glad to refer you to a larger office with more accountant staff available to help you.

The initial filing date and final 2020 tax payment date for  individual income tax returns is now May 17, 2021.  Please note that SOME state-loca l individual tax returns and the 2020 taxes still needed to be 98% paid by April 15, 2021 to avoid late fees and interest charges.  Also, Congress did not include C-Corporations, Estates, and Trusts in the extended initial due date, so these and the taxes for these entities were still due April 15, 2021.  The IRS has implemented plans for the extended federal income tax filing deadline for individual returns. Our partner Drake Tax Software's programmers has updated the individual federal returns to accommodate the revised May 17, 2021 filing due date and tax payments (added recently) due date.  Deadlines for other return types were not affected (other than those previously announced for the winter storms in some states (see below)).

  • Filing due date – 5/17/2021
  • Payment due date – 5/17/2021
  • Default payment withdrawal date for electronic funds withdrawal – none. You must enter a requested payment date on the PMT screen to clear EF message 2522.
      • 4/1/21-- IRS adjusted the business rules to allow requested payment dates for electronic funds withdrawal beyond 4/15.
      • An update to Drake20, released 4/2/21, allows a requested payment date up until May 17, 2021 for the 1040 main form.
      • EF message 5299 now only generates if a date after 5/17/21 is entered on the PMT screen.
    • Extension due date – 5/17/2021
    • Default extension payment withdrawal date for electronic funds withdrawal – none. You must enter a requested payment date on the PMT screen to clear EF message 2522.
      • 4/1/21-- IRS adjusted the business rules to allow requested payment dates for electronic funds withdrawal beyond 4/15.
      • An update to Drake20, released 4/2/21, allows a requested payment date up until May 17, 2021 for the 1040 extension.

    • Payment due date – 6/15/2021
    • Default payment withdrawal date for electronic funds withdrawal – none. You must enter a requested payment date on the PMT screen to clear EF message 2522.
      • 4/1/21-- IRS adjusted the business rules to allow requested payment dates for electronic funds withdrawal beyond 4/15.
      • An update to Drake20, released 4/2/21, allows a requested payment date up until June 15, 2021 for a TX, OK, or LA filer.
      • EF message 5299 now only generates if a date after 6/15/21 is entered on the PMT screen.
    • Extension due date – 6/15/2021

    1120, 1120s, 1065, 1041, 990, and 706 returns due after February 11, 2021 and before June 15, 2021 for filers in LA, OK, and TX affected by the February winter storms

    Important: Due dates did not change for any other package except for filers in LA, OK, and TX affected by the February winter storms.  Those changes are as follows:

    • Filing due date – 6/15/2021
    • Payment due date – 6/15/2021
    • Default payment withdrawal date for electronic funds withdrawal – original due date of return  
      • IRS is not adjusting business rules to allow requested payment dates for electronic funds withdrawal beyond the original due date for these filers. They will not be able to schedule future payments after the original deadline up to 6/15. If they are filing after the original due date, electronic funds withdrawal will have to be made the date they file or an alternate payment method must be used.
    • 1st quarter estimate date – 6/15/2021
    • Extension due date – 6/15/2021
    • Default extension payment withdrawal date for electronic funds withdrawal – 4/15/2021
      • IRS is not adjusting business rules to allow requested payment dates for electronic funds withdrawal beyond the original due date for these filers. They will not be able to schedule future payments after the original deadline. Extensions filed after the original due date perfection period will have to be mailed.    
    Note: Not all state due dates will be correct at this time. As Drake Software gathers information from state Departments of Revenue, updates will be released to correct the due dates for state returns, payments, and estimated tax payments.

New Business Hours and Appointments Still Required for Priority

Seasonal extended appointment hours have ended and our summer/fall hours start on April 20, 2021.  Our hours change to  9a - 6p eastern time, or 7a - 4p mountain time, on Tuesdays through Fridays.  We will keep a limited number of evening appointment openings available for owners who cannot meet remotely during the business day.  Jeanine and Calvin will be involved with family business from April 17 to April 19, prior to our re-opening on April 20, so will not be returning phone calls or doing meetings during our personal weekend.  As usual the e-filing system will shut down around Thanksgiving.  We are normally shut down for holidays shown at https://cp7.cpasitesolutions.com/~bctincje/Closures.php and update our financial systems in January while the IRS e-filing is shut down and Congress gives us their final law changes for the tax software.

Unemployment Scam submitted by partner Drake Tax Software
This season has seen a rise in fraudulent claims of unemployment benefits from unscrupulous scammers. The result is that taxpayers may receive a 1099-G for unemployment benefits from certain states even if the taxpayer never made unemployment claims, or has never been in the state. IRS reminds taxpayers that using the IRS Tax Withholding Estimator to do a Paycheck Checkup that can help them have the right amount of tax withheld and avoidThe  surpriseswhen filing next year.  Because income taxes are pay-as-you-go, taxpayers are required by law to pay most of their tax as income is received.  This may be accomplished by income tax withholding or by estimated tax payments.  Don't forget about your state/local tax liabilities, as well as your federal liabilities.

Taxpayers should use Where's My Refund? on https://www.irs.gov to track their refund status and Get Transcript, both common requests.  Each state/local department of revenue, such as  https://www.colorado.gov/pacific/tax/wheres-my-refund for Colorado, also has a tool on its website for tracking tax refunds.  Please google your state/local department of revenue to access the link appropriate for your state/local refund.  Interest on individual 2020 refunds reflected on returns filed by March 15, 2021, April 15, 2021, or May 15, 2021, depending on type of return filed, these due dates until the date of the refund.  Interest payments may be received separately from the refund.  You may also wanto to check out https://aidassist.intuit.com/app/home?cid=owned_QB_IPD#/home to check out the Tax Credit Estimator and the Paycheck Protection Program (PPP) Loan and Forgiveness Estimators.

HELPFUL 2021 Income Tax Season Links

One way people can get the new tax year off to a good start is by checking their federal income tax withholding. They can do this using the Tax Withholding Estimator on IRS.gov.  All taxpayers can use the results from the Tax Withholding Estimator to determine if they should:
